    is it legal for a gas station clerk to smoke a cigarette ?

    i know it is illegal to smoke if your pumping gas but i see clerks standing outside by the pumps and smoking . what is the law on this ? i know at my office it is illegal to smoke within 25 feet of the doorway .even if it is not illegal ... what happened to common sense ?
