Lets say a neighbor smells you smoking weed in your backyard and calls the cops. If the cops show up at your house and you are baked out of your mind can they arrest you?
Honestly, I do not think so. If your in your own house and smoking there, a cop well care less, unless you did something else. For Example, you went to school and had weed on you, or you were outside trying to do something stupid or what not. But to tell you the truth, this just happened yesterday. I was in a car with some homies and we were just blazing, and i guess one of my homies got into an argument with someone else, they were yelling loud and someone called the cops i guess because they came. I was already parked when they came but anyways, the pigs knew we were all high cuz it smelled like straight out dank lol. He just told us if we were smoking and whatever, we said yeah, he checked our car, checked us and whatever, I thought he was going to take the car, because it wasnt even mine (it was my moms, but she didnt know i had it), and he just told us to give them our names, and they ended up leaving. That happened today like at 3 in the morning. By the way, I'm 14. He said to one of my homies that he can arrest him for public intoxication, but he didnt because we all acted normal.
Here are some tips if you ever get in to a situation like this:
Act Normal
Dont Get Or Act Paranoid
Tell your friends to chill out and act cool
Dont have anything on you, and dont do or say anything stupid to that cop
So the answer is no. Theres only like a %4 chance he will give you a ticket, but he can't arrest you.
