can i cancel an AT&T data plan after getting the smartphone?

i already have a data plan under my line. my dad, whos in the family plan with me, is due for an upgrade. is there any way i can use his upgrade to get a new smartphone for me but not add a data plan for him?
also, what if i get the upgrade under his line and then cancel the data plan when i get the phone and he uses his old phone and i put my sim card in the new one?
what i meant when i said cancel the data plan, was that i meant HIS after the upgrade. i'll still have my data plan and i'll put my sim card in the new smartphone but his data plan would be the one cancelled
 
1st. no WITH ANY SMARTPHONE you HAVE to have a data plan.
2nd one yes you can upgrade your line threw his. but you can't cancel the data plan. you can use any at&t phone with your sim card.
 
No. You can for sure use his upgrade to upgrade your phone but if you give him a smartphone it's going to require a data plan. You can always change the data plan to lower it the $15 150mb but you cannot get rid of it completely.
 
cross upgrade, take his phone, set his phone back to his old one, eseentially it will just extend his contract 2 yrs, if you already have data, you can put that new phone on your plan at no additional cost.
