Can I get out of my Dish network contract if they take away Fox?

Supposedly on November 1, 2010 Fox will no longer be available to Dish Network subscribers. I live in a area that doesn't offer a local broadcaster so getting satellite was the only option. Now I find out that I will be loosing Fox which is about the only channel I really watch on Dish. I do have an option of going to Directv but upon contact with Dish Network they told me if I fail to pay they will charge a penalty. Can they really do this?
