My husband recently had his car vandalized by someone with schizophrenia. She carved his paint with his own license plate while he was in school by someone that was suffering from schizophrenia. There were plenty of witnesses and the damages totaled to approximately $4000 dollars. According to her godfather, she forgot to take her medication that day and she lost it on my husband's car. Her godfather seemed to miss her go around the other side of the school to carve on my husband's mustang because "she loves mustangs." The godfather was the current guardian at that time because she cannot take care of herself and he was begging for us not to press charges. She got charged with a felony and got taken to a mental institution to get stabilized and checked. Today, we called her godfather and now he is saying he has nothing to do with her, I assume this because he doesn't want to pay for damages. If this girl supposedly forgot to take her meds that day and she was under the care THAT DAY of her godfather, can I sue either one of them? Because it looks like the girl can't take responsibility because she was out of it and the the godfather didn't do it, he just takes care of her. Who do I go after to sue and can I sue a schizophrenic? I've asked around to people with knowledge of the law and I can't find a really direct and thorough answer. Please help because I don't want to go to a small claims court and end up paying the court costs and turn out with nothing later. Thanks.
