Cigarette smoking in apartments?

Start with the smoker,about throwing butts into your yard there toxic to the child. If no satisfaction start working your way around agencies that can help.

So the guy that lives upstairs is always smoking and somehow whenever he is smoking the smell basically goes right to my room where my 20 month old son and I sleep. (he usually smokes at night when he gets home i assume).

Is it wrong for me to bring it up to the landlord? Or do they have a right to smoke where ever even though the smell comes into my place?

Also when he actually does smoke outside his balcony, he throws the cigarette butts into my little yard, so whenever i go outside i have to basically pick up ever single cig butt before my son picks them up.

Is there any smoking laws for apartments in california?
 
Your landlord would have to ban smoking in the apartments as part of the lease. I don't know if your on a month to month or a year lease and if the landlord can change policy in the middle of the lease, he would have to check the fair housing act. As for the cigarette butts I would say something either to the guy or your landlord. That is disgusting and makes places look trashy. I am a smoker myself and I understand the purpose of ashtrays. Ask him to please use an ashtray and not throw them in your area because of your son, plus if he wants to make his area look gross that's fine. If he won't listen to you talk to the landlord. If he wants to keep you as a tenant then he needs to speak with HIS tenant about being respectful to his neighbors.
