Did Costco sell me a refurbished laptop?

I recently bought a laptop at Costco (HP dm4-1253cl). When I turned it on for first use, the "Windows was shut down incorrectly. Start Windows Normally" screen welcomed me. And when I surf the net, the browser screen flickers, especially when I type.
Costco has a 90 day return policy, even if the laptop has been used. So I'm assuming laptops that have been used and returned are recovered and sold as "new" again. I just want to know, can they do this without the buyer's consent? I mean, I wanted to buy a NEW laptop, not a refurbished one. If I wanted a refurbished one, I would've gotten it.
I am so dissatisfied with Costco and want to return the laptop. :/ What should I do?
 
This sounds perfectly normal, HP does a first time boot up at the factory before they send them off, maybe it broke down during the first boot up and they sent it off anyway..gay but it happens.

If you kept the reciept you can return the machine, if you dont have it, your outa luck.

Buy a mac next time, apple doesnt do that kind of crap
