Do you have to do a termination fee if you want to downgrade your iphone?

I have a iPhone 3G with At&t and want to downgrade to a regular phone with At&t because my current service bill is just way to much money for me.

I want to know if i get a new pphone with at&t with a new cheaper service fee's would they make me do the $175 termination fee???
