does my son have to go pick up a subpoena the sherrifs dept says they have for him?

My son was picked up 6 months ago for having pot in his car. the police dept pressured him and told him to give up his supplier- saying they would never tell the dealer my son was the one- of course the police lied- he is only 20- and was scared of course. Now they called him and told him to come to the sheriffs dept and pick up a subpoena they have for him to tesify at the trial- If he doesnt go pick it up can he get in trouble? dont they have to find him and serve it? He really does not want to tesifiy against this drug dealer in court, and I don't blame him- as after the dealer was arrested he called my son numerous times yelling at him for turning him in- of course my son is afraid for his life- and he knows what he did was wrong- he went to court and owned up to his stupidity- and is on probation for it- any advice would be great!

The first thing you need to do, is kick him in the ass, for being stupid. Then take out a life insurance policy, make it a big one.
And DON'T go get the subpoena, its their job to deliver it.
And, if they do, he has to go to court, but he doesn't have to "recall" anything, about what he told the cops,they don't even need his testimony, they're just trying to get him killed.
Let this be a life lesson, cops lie, period, they do it under "oath" I've seen it happen, myself, the judge's believe everything they say, regardless, and the DA makes up a scenario to fit the case, and the judge's believe that too.
And, the cops know this, and take full advantage.

No they are supposed to serve it on him. He isn't required to go down there and pick it up but check with an attorney on this one to make sure and make them serve it on him. If he isn't served he is under no obligation to go to court as their witness and also tell him to plead the 5th and tell him to call the Prosecuting Attorney and advise them that he is going to plead the 5th, they will love that one for sure. HAHAHAHAH

A subpeona has to be served to him. He does not have to pick it up...talk about a lazy sherrif's office. He will have to testify. If he is asked questions and "does not recall", there isn't much they can do. I hope your son has learned his lesson and chooses another path in life.
 
i always thought the subpoena was delivered. if he knows about it he has to get it and sadly, yes, he has to go to court. if you are given a subpoena and dont show you can have a warrant
