Emule downloading and internet question?

I'm downing songs off Emule using a public (not-security enabled) wireless network in this building I'm staying. I have two questions:

1. Can you get caught if you are using a public wireless network? How can they find out (since I'm using a laptop)?

2. Is it illegal to download music with Emule?
