...Environmental Health Department? I have a neighbour (lives alone) who is in her late 60's and since the day she has retired, she has never stopped moaning and groaning about some noise coming from our house, particularly from the wall where the boiler is situated. Its not bothering me if I can fix the problem, but not getting to the problem is making me sick.

I had British Gas in day in day out, and on all occasions they have said that there is nothing wrong and the Boiler, and is operating to manufacturer's specifications.

Because of her constant bombarded complaints to the Environmental Health Department, they have emailed me to say that they will issue me with legal papers, and want the owners details as soon as possible!

Where can I go about this - Please help?
 
Environmental health do not issue people with legal papers because of a noisy boiler that has nothing wrong with it. Why don't you tell us the full story? You know the one about the loud music etc...
I'm sorry, but you are not giving us the full story here and you know you're not.
 
Bertie Wooster has read =between the lines= and after my own reading of the question set, I must go along with =his opinion=.
 
I am a tenancy manager and deal with these cases on a daily basis. Tell the Enviro dept that you invite them to your property at any time to prove your innocence. Put this in writing or email. I also suggest that you write to them stating that your neighbour maybe a malicious complainant. There are many of these people out there. She may also have mental health issues so treat carefully.

If you're really worried, then use the services of the Citizens Advice Bureau. I would also demonstrate that you are willing to solve the issue by contacting your local borough council's mediation services. If you can, find out on average what days and time of the day your neighbour claims that you are causing noise nuisance. If you have a camcorder, then put it on record in the same room she says the noise is coming from. Hopefully this will prove her to be a liar!

The Enviro threatening with legal papers without confronting you is rather unsusal, unless they just sent you their standard 'drivel' letter. Go to THEM, do not wait until they contact you again.

I must stress that the first advice you will get is to try to talk to your neighbour, offer her to knock your door any time she hears the noise and ask whether you can go into her house to see if you can hear it but take a witness with you. Only use the services as a last resort. Good luck
 
Personally , I'd report her to the Police for harassment

Surely the local council have to come around and do a 'noise test'

when they measure level of decibels etc.

How can anyone possibly issue you with legal papers

until they have proven evidence

Don't give anyone your personal details, especially in an e-mail

Tell them to come and visit and let them do the required observation and testing of noise levels

How did Dept. of E.H. get your e-mail address,anyway ?
 
I don't know but why don't you get in touch with the department in person and speak directly to THEM. Tell them you have no idea what this woman is on about and that you are open to them coming and investigating your home any time they please.

Maybe that will shut them up.

Otherwise talk to a lawyer. Certainly the Department themselves ought to be able to tell you who you can talk to if she is making a false claim.
 
It could just be some sort of a high pitched whine that you can't hear. Some people can hear dog whistles, others can't. Perhaps she just has exceptional hearing in that specific range? If you've already been in contact with the gas company and the manufacturer, it seems as though your bases are covered legally.

Perhaps there's a way to wrap it in walling insulation, to dampen a high frequency sound, just so you don't turn your neighbor into a raving homicidal lunatic?
 
Is it the boiler or do you have a stereo/radio or something similar situated nearby.

Whilst younger people are used to a continual cacaphony of din emerging from various electronic boxes, such sound can carry easily through walls, especially if one uses and amplified bass system or plays drum and bass or similar approximations to the Terpsichorean muse.

The law (in England) states that you are not allowed to make a noise that interferes with the quality of life of your neighbour (literally, prevents one from enjoying one's own property); but it is sufficiently ambiguous to state that there should be no restriction that stops you from enjoying your property as long as the noise emitted is 'reasonable'.

If you are playing music that is audible inyour neighbours home, then there are grounds for complaint from your neighbour. If it is your boiler, then there is not a lot of redress.

Analyze the causes. You do have the criminal offence of Harrassment to fall back upon if you think you are being persecuted because of your age. This is a Police matter, so contact them as soon as the alleged offence occurs,
 
You approach environmental health and ask them to install sound equipment,either to your neighbours property or yours..That will show if she is being unreasonable..I do understand how she feels though if she wants total peace and quiet as i sometimes do but if we have close neighbours,i'm afraid we just have to adapt and overcome...................
