I purchased a bike (Yamaha Thundercat) this Tuesday from eBay and have discovered a multitude of problems with it since sale. I had the bike at the shop today to have the speedo illumination bulbs replaced and the mechanic noticed a large hole in the exhaust downpipes - I was told specifically over the phone before purchase that the exhaust was welded a while ago and that it was solid, and the ad on ebay itself stated that the bike has "no outstanding jobs whatsoever".
The seller also signed an agreement stating that if any mechanical or electrical problems are found within the first 2 weeks that i was not made aware of at the time of sale the seller would pay for repairs (parts and labour) or offer a refund providing it wasn't a problem that could have been developed in the length of my ownership. As I have only owned it three days and not ridden it much due to the weather i find it hard to believe a hole this size appeared in the time the bike has been in my possession.
I've been in touch with the seller who believes it's nothing to do with him as it passed an MOT two weeks ago and that i must have put the hole in it... long story short he's refusing to pay a penny.
Is there anything I can do, or any legislation that would protect me in this situation? A refund would be brilliant but the seller is less than willing to cooperate.
