I found a samsung impression, can I use it?

I found this phone at a nearby parking lot in a snowbank. I called the phone's number that was under the settings/phone months later and someone answered the number. Does this mean that this phone has been forgotten about? Would I get in trouble if I removed the sim card then took the phone to my local att to set up an account? Im not currently an att customer.
