If you both owe the interest and pay the interest you can deduct it. Head of house hold, children and marital status don't matter.

Who is paying the majority of the mortgage or are you or your husband court ordered to pay a portion? Say if you split the mtg 50/50 then you are each entitled to claim 50% of the interest. It is whomever is paying the mortgage.

To deduct the mortgage interest you must be legally obligated for the payments AND you must actually make the payments. If you paid some or all of the mortgage payments then you can deduct what you actually paid. If you didn't pay any of it, then you may not deduct anything.Filing status has nothing to do with who can claim the deduction. The legal obligation and the actual amounts paid are the only tests that you must meet.

See IRS publication 504 on the rules for separated individuals.If you both own the house by tenants in entirety, then he can deduct the mortgage interest he actually paid. If you paid half, he can deduct half. Even if you take the standard deduction, that does not give him the right to claim any money you paid. The same goes for the property taxes.If you actually live together, you can't even file as HOH.

Well, they aren't directly related, but since by filing head of household you are saying that you provide over half the cost of maintaining the household, and by claiming all of the interest deduction the other parent is saying they paid all of the mortgage, it wouldn't be likely you could still prove that you paid half of the cost for the household.
