I would like to write a book based on middle earth but i don't want it to seem

Just don't name it Middle Earth
Don't include two towers
Don't create a Shire filled with Hobbits
Don't include rings - especially one to rule them all
Don't create a watchful eye
I could go on

Basically make your own world
 
like lotr, any ideas? I am worried that the book will turn out more like lotr (lord of the rings) than anything else and i want to make it unique, if i get it published i don't want readers to think i just nicked ideas from lotr, so has anyone got any good ideas on how i can combat this?

I don't know, think of an original idea maybe? why not call it central earth and call them nobbins instead of hobbits
 
Well, try naming it something other than Middle Earth to begin with. So long as you don't use the same ideas that Tolkien used, then nobody will compare it. Just plan your world out so it's different. Use http://larseighner.com/world_builder/index.html to help you build your world.
 
You can't. Middle Earth was created by Tolkien. Any story you set there is by definition LotR fanfiction. Fanfiction can't be published.

You need to create your own fantasy universe.
