With all of this documented getting temporary custody should be easy. Call a lawyer immediately and work on getting permanent custody. I wish you the best.
 
Recently my child’s mother has been having some personal issues with life and has committed her self into a few different hospitals. One of the things that have got to me is that I had to find out about it from a 4 year old that their mother is in the hospital and that the step father is laid back on the sofa while my child’s 11 year old ½ sibling is pretty much taking care of them. After my child’s mother was released from the hospital I asked her about it and she said she didn’t want to talk about but ended up telling me most of everything. Comes down to it she Bi Polar and cant seem to get a grip on life. I informed my child’s mother that if she ended up back in another hospital that I was going to take my child to come live with me for awhile until she was able to get her head clear and get back on her feet.

Guess what? To my surprise my child tells me their mommy is back in the hospital because she’s having fun there. I called the parents of my child’s mother and her father informed me it was pretty bad. Bad enough for her mother to take off and try to save her daughter and bring her home to get her help in the city but by the time she arrived the local sheriffs department had escorted her to another psychiatric facility. I called my child’s grandparent and asked if she would be willing to pack my child’s clothes and bring them home to me and the grandparent replies “I think that would be a good idea”.

Two days after my child comes to stay with us we get a phone call from their mother. My x basically told me she tried to end her life while at work and I told her to just do what she’s needed to do to get better that our child is going to be fine with me. 2 more days I was informed that her insurance would no longer cover her and the facility released her.

My child has been with me for 3 weeks going on 4 at the end of this week and their mother is making the claim that she is doing fine and wants our child back. I don’t think she is because she cant answer any of my questions about follow up visits, she ran off from her husband to hide out with some one in her support group that lives 5 hours away, she comes back to him and they are the happiest couple in the world, 2 days later she’s so unhappy and doesn’t know what to do but yet wants out child back to keep them at home during the day with her and them bring him to Pre K in the afternoon. I'm no fool and not going to let this take place. She’s demanding I have their stuff ready because she coming to get them Saturday. I need some feed back big time.
 
Talk to your lawyer. She is unstable and you should do whatever it takes to keep your child. If she receives treatment and is doing well than she should be involved in your child's life. Right now you need to take control and find out what you can do to keep the child with you until the mother is well.
 
Based on these circumstances you need to get a temporary emergency custody order so that the child does not go back into her household. An attorney that does family law should be able to do this for you fairly quickly.
