if i buy a BlackBerry Pearl off of craigslist from someone, am i able to use...

...it without extending my plan? i have a LG CHocolate...my plan is almost over but i want to get another phone...without extending my plan..can i just purchase a Berry Pearl off of craigslist and just activate it online and use it then and not extend my plan?
