In Judaism, when is death an acceptable punishment for deceit ?

Now, we all know the God given principle of 'ayin tashat ayin'. In pure literal sense, it would be understandable that deceit must be paid for in deceit

But, here is my point. What if the enemy's deception has led to death or destruction. In that case, should he not be killed because of the consequences of his deceit ? Or should we still stick to the literal interpretation and deceive him ?
