All movies have copyrights -- meaning that if you download the movie, you are already infringing copyright laws, even though you own a copy of it. this is because you are downloading a reproduced copy of it.

Should you do it? Its up to you.
Is it risky? Not really, the people who really are at risk are those who actually pirate and distribute the movie. We are talking about the big time pirates who are actually worthwhile to bust. The cops are not going to kick down every single door of every p2p downloader.

First, IANAL.

When you download, there obviously is a chance that you could be flagged as downloading pirated content (regardless of whether or not you have the content already). Fighting this would be a headache but I think in the end, it would probably be dismissed. Now that said, keep in mind that the content would have to be a VHS version of the content in digital form, not a copy from a DVD since there is extra content (higher resolution, extra scenes, commentary, language support, etc...).

Now the content providers will have a very different view of this since it is in their interest to generate as much revenue by reselling you the same content several times (ex. how many editions of Star Wars does one really need - Original VHS, The Collectors Edition VHS, the Refinished VHS version, the DVD version, the Trilogy DVD, the Collectors DVD version, etc...).

While it may not be legal to download the VHS torrent of the movie, my conscience wouldn't weigh too heavily on this as long as I have the original media in my possession. Unfortunately I think if you go for the DVD torrent version, you are getting into that gray area that I would tend to be more cautious of.

I have a few dozen movies on VHS, my video player is broken, I want to watch these movies again. Can I download them from Bittorrent without any legal repercussions?

I'm afraid thats still copy right infringement

but to be honest theyre not going to catch you

Yes, because you only purchased one licenced copy.

It's even illegal officially to copy the VHS tape you have.

Cheaper to buy a new VHS player than pay the fine.
