My friend is dating this guy who is waay older, is it even legal? lol?

My friend is 16 almost 17 this summer and her boyfriend is 20. They are in California. She lives with her mom, he lives at his own place. He moved from Ohio, but even before he came to California her mom and her would fly to go see him every three to four months. They've been dating for a year now. She spends the night at his house, he spends the night at her house. I know for a fact they are sexually active. I mean, I love both of them but everyone gives them crap about it but me.

My question is, is the even legal? Can she get in trouble? Can he get in trouble? Can her mom get in trouble?
 
It is still legal to date people that are older but it is illegal to have sex with a minor. If the parents want to act out with a restraining order against him they can since they are still the guardians of her. Best to seek local state laws.
 
If that guy was 31, I would have called him a paedophile but in this case I see nothing wrong with that.
 
It is probably illegal as most US states have an age restriction of 18 on sexual activities and it can be a misdeameanor to a felony for someone over 18 to have sexual intercourse with someone younger than 18.
 
i don't think they can get in trouble. because the mom is cool with it. now if the mother had a problem with it she could report it. but the girl will be 18 soon and they are not that far apart in age. who knows they may get married. it could work out
