Now i have no pics or vids an phone is still broke an they say there is nothing they do , now the call was recorded so do i have any sort grounds to seek action against them .

call back and demand to speak to the supervisor. Make a complaint. In my experience, some of the customer service officers that work for nokia havent got a clue about their phones. I too have an n8, and in my experience, they have no idea how the symbian^3 platform works. U shouldve come here first, anyone here with experience wouldve told u a hard reset will format ur phone. Worse still, u arent supposed to hard reset a symbian^3 device, as a result, uv lost vital files to the running of ur phone and need the firmware reinstalled which nokia care can do, and should do free of charge.
Theres data recovery software u can try on ur pc but its most likely that uv lost ur data forever.
Call them, demand to make an official complaint. If u cant get passed the initial person u speak to, go to their website and email them. Im my experience they take complaints seriously.
