Options to sell full tank of oil?

Two weeks ago I bought 220 gallons of heating oil @ $3.77/gal costing $829. The first night I called for heat, the furnace failed. The maintenance man then condemned my oil-fired hot air furnace. I've since replaced the system with a natural gas furnace but still have the full oil tank. The company that sold me the oil does not want it back, can't blame them either.

The tank removal company wants to charge $350 for removal with no adjustment for the free oil they will get!

1. Is it legal for me to sell the oil privately? I'd take $2.75/gal.
2. If yes, what is the best way to extract the oil (home depot doesn't rent a pump for this use)

Any suggestions welcomed.

BTW, I'm in Massachusetts.
