I got in a rear end collision while pulling into a gas station parking lot. I was turning left crossing the other lane into the gas station when a 16 year old girl talking on her cell phone turning off a side road speeding hit my rear passenger side quarter panel. I have a 1995 Lincoln Mark VIII which is a 2 Door and she hit between the door and rear tire with the passenger side front corner of her bumper. When I began to turn she wasn't there and I was already 3/4 the way into the parking lot when she hit into me. The police were not there during the accident, however, there was two witnesses. One witness said it was my fault, which also knew the girl and another guy from Indiana saying it was her fault. What I was wondering is where does Ohio state determine the beginning of the rear end of a vehicle? I know that in Ohio, no matter what the circumstances, if you hit the rear end of someone you are automatically at fault. They cited me for failure to yield the right-away. The people that hit me also seemed to know the police officer by first name, could there be bias involved? The witness who said I was at fault was on my driver side and not in plain view of the accident and the person who said it wasn't my fault was right and front of me and I turned after they did, they told the officer it couldn't have been my fault because I was right behind them turning and the girl was still way down the road and the only way should could have hit me is if she were speeding and failed to control (stop). The witness that is on my side gave me his phone number in case I need him. Also, the girl also admitted in front of witnesses that she had just had a car accident.
