Rogers ISP Tracking Illiegal Downloads?

Hey iv been downloading games movies etc for a long time now from isohunt.com and once i called them and asked if it was illegal to download and they said NO. now latley we have changed our modem to a surfboard 5B5100.
OKAY HERES PROBLEM: I downloaded PSP GTA Liberty city stories EUR from isohunt and then got a message from rogers then later on my crysis woulnt work cause the cds scratched so i download it from isohunt and i get a secound notice. IS Rogers using SPYWARE ON MY COMPUTER? or the new modem sending used torrents to them.
