Would this fall under self defence in youth court in Canada?
Two intoxicated females approach a sober male and make several racial slurs. They then begin to push him several times. As he retreats, they make more comments (very hostile still), and he spits from 5 meters back. The spit does not touch any of them at all. One female then runs at him and delivers 4-6 punches to his head.
She was not stopping, and he finally subdued the female with 1 hit. Her eye was quite badly injured. He was charged with aggravated assault. All witnesses gave the whole story (described above) except for the females friend (she claims she never hit him even ONCE). The male later went to the hospital and has a report of his severe concussion, which his lawyer now has. He is a straight A student, no prior record, etc...Girls are party animals, with lots of proof to support this.
Will this go through as self defence, given he has a good lawyer and the facts above?
