Should I sue T Mobile? please help me?

Here's what happened to me. I bought a $500 HTC Smartphone from T Mobile that I found was defective, I had to ship it to them so they would send me a replacement, They said the replacement would arrive in maximum 7 days and now its been over 16 days and nothing came, when I called them they said they will file an escalation because they can’t find the defective device I sent (I sent it with UPS and I when I used my tracking number from UPS to check, I found that it arrived to T Mobile on time and they received and a person signed that they received). I called today and they said that it will take 3 days maximum so I can find the result of my escalation and my phone was lost they said they may be able to give me a refund. Now my question is if after the three days I found the phone was lost and they didn’t wanna give me a refund, should I file a lawsuit and try to sue them? Thanks
 
If that was the case all phone companies would go out of buisness meaning you would lose the case no matter what
 
You can launch any suit you choose. That doesn't mean that you will win, though. How much are you willing to spend on lawyer's fees?
