I was terminated in D.C by Harris Teeter, I had 92 hours of unused vacation time. I know that D.C. has no law on vacation pay either way but North Carolina does. My old company is incorporated in NC so shouldn't they be bound by the laws of that state rather than misuse the law or lack of such laws in the states that they have stores in? In my employee hand book (they have different versions depending on the state) it does not "entitle me to my vacation at time of separation" but I believe in the Carolina s they have no choice but to pay out.

Just because the company is incorporated in NC, that has no impact you in. You work under the laws of DC.

In NC, if there is no company policy stating otherwise, the company is required to payout vacation at termination. However, if the company has a written policy, they can determine how vacation is paid at the time of termination.

California and Nevada have laws that require vacation payout at the time of termination but I don't think any other states do.
