what is the law concerning about child custody?

before husband had the full custody of the child,but,not living w/him and not giving child support (and is living w/grandmother,paternal side)and real mother,the goverment used to give child rearing allowance every month,is there any case that can be use to filed before husband?what r the rights of the children?
