Who has the right of way in the scenario described below? Who is at fault if...

U-turns are illegal at controlled (lighted) intersections. (Even if there isn't a sign - I mean there isn't a sign floating around saying "Don't Kill People" to remind us it's illegal)

That's not to say the person making a right-hand turn has the right to enter the intersection when it isn't safe to do so.

Could be a case of 50% 'at fault' Although I'd side with the person turning right.
 
...they collide? One person is waiting for the traffic to clear so he can make a (legal) right turn on a red light. Immediately to his right the other driver has his left-turn signal on and is also waiting for the traffic to clear. However it turns out that he isn't making a left turn, he's planning a U-turn thru the intersection while his light is green. There aren't any "No U-Turn" signs. When the traffic clears they both move at the same time and come nose to nose but don't collide. What if they had?
 
the one at the red light making a right turn would be at fault
he had the red light and stopped
the guy "even though its a u turn" had the green light
 
so the guy making the left hand turn (or U turn) had a green light but was yeilding to traffic so he has the right of way

I am not a police officer, but I would guess the person making the right turn on red. In states where you can do that, it should only happen if the road is clear and if you misjudge that I'm guessing technically it would be your fault for not yeilding. I do think the person turning left should keep an eye out for the entire intersection though, so they both would contribute to the problem.

And this is only if it's not illegal to make U-turns at intersections in your state. Every place is different . . . where I live it's perfectly legal, and so is turning right on a red (but yielding to other traffic first).
