50cc bike has had a top end rebuild but won't start!?

Hi there, I own a 50cc peugeot XR6, I recently did a top end rebuild I followed a lot of tutorials printed numerous workshop manuals to do this correctly as its my first time.
The reason for rebuilding, road it fine all day in nice weather, park it for the night, won't start it the morning. I take the top cylinder off and I noticed the piston was all scraped and only had one full piston ring (top) and the bottom had only half and the rest seemed shattered and missing.
So I completely cleaned, added new gaskets rubber seals and put it all together following tutorials to a tee.
Now the boring bit is over, my battery is dead so I have to bump start it, I run with with it up and down my road, nothing, after about ten minutes I try again and it fires but if I turn my throttle will stall, like fuel starvation I don't know, that is with choke fully on..
So I try again after about 30 minutes and run with it and it fires up it sounds good so I sat on it went for a ride down the road and bam stalls, and back to it firing and stalling which I mentioned before.
I've only recently got a brand new, CDI, spark plug and spark plug cap.
Any help would be great?!
