Any way to upgrade to a smartphone with AT&T and avoid the now required data plan?

For months, I have planned on upgrading to the Samsung Jack when I'm eligible in November. I just found out that AT&T is now requiring all upgrades to smartphones to require a $30/month data plan. I currently have the Samsung Blackjack I, and like having a smartphone so i can text easily and use the appointment calendar, and other features that do not require internet.

Does anyone know a loophole around this?

You have to get the data plan, but if you really don't want to you have to do this thing called jailbreaking your phone. And I wouldn't do that because if AT&T finds out it wouldn't be very good. So it's eithe rpay... get another phone... or switch companies. SORRY
 
My advice is don't get a smart-phone because the two features you just described can be found on most phones today. You only need a smart phone if your constantly use internet and email. No loophole man, but just to let you know it was a great idea to require people to get the plans because as I'm sure you've seen on the news, that people have run up $23,000 bills without this plan so it was in our best interest.
