Martial arts school didn't deliver a product which I purchased. Can I get my money
back? I signed up for a Karate class for my 7 years old son in a local martial arts academy. Few weeks later, the academy distributed a flyer about the need of purchasing a personal sparring gear. They said it'll be required as the kids will be prepared to advance into sparring skills and this is required for protection and for schools' liability insurance. The cost was about $185 for the full set. It sounded a little bit pricy, but paid for it for the purpose they explained. They said they will order it and we should receive it within a week or two.
Few weeks have passed and I didn't get it, I inquired but they said that they're still waiting for all the parents to pay then can place an order for the whole class's supply at once. Two months have passed and didn't get anything, by talking to other parents individually, I realized that nobody have bought it since everyone explained that he/she was not financially ready at that time but they're planning to as soon as they can . Also, one mother told me that she mentioned to them that she already has a set but they told her she still has to buy it from them for liability purposes and they can not guarantee any product purchased outside their school. I decided to wait two or three more weeks but realized that still no other parent has purchased it and I was the only person.
I then asked for my money back since they failed to deliver it timely and nobody else has purchased it and therefore the classes will be held without it. The academy said they will get "my" sparring gear on next class since their money refund policy is only valid within "three days" of purchase and now it's close to four months!
How good if they brought a sparring gear only for "me" (regardless to the brand), it will still be useless under these circumstances. I acted reasonably within the scope they explained (safety, protection for kids sparring classes, etc.) and will end up with a product that is no longer needed or stuck with their refund policy!!
I'm very frustrated! My question: can I get my money back under these circumstances? How?
