time employees? When hired, the employer told me that we would be off a week for Christmas and a week for 4th of July. There is no contract. We closed our office for a week for Christmas this year and none of us full time employees(that have been employeed there for atleast 3 yrs) got paid. One employee went to office manager and questioned it. She was told that it was an oversight and she would give her a check. 10-15 minutes later, I went and questioned it also and was told that we are not supposed to get paid for that time off. Well, she paid only one of the full time employees and not the rest of us. There are only 4 of us that are full time and been there a minimum of a year. Is this legal???

If your state does not require paid vacation, they can choose to do whatever they want. It's a gift, not a requirement.

You haven't given sufficient information to he certain. But I would hazard a guess that it is perfectly legal. There would be other factors at play here. Different employment contracts if you were hired later or earlier than the other person. Maybe that person took payed leave that they had accrued. Maybe it is illegal. It is impossible to tell without more searching.

Maybe she worked out a separate agreement and refused to work unless paid for vacation. If they wanted her badly enough, they might have agreed and if you didn't work out that agreement, then you don't get it. It's not illegal to have different agreements with different employees. No different than paying different amounts, really. It's not good for morale, though. She should have kept her mouth shut.

First answer is totally wrong. If you have a union contract, and everyone is subject to it, then it would be a breach to treat some differently. In the absence of a union, then everyone is free to negotiate their own terms. As an employer, if the only way for me to hire a valued person is to offer paid vacation, that is my choice. If I can get someone else to do the job without such a demand, that is their choice.
