Can bank repo my car if I am going through BK?

I am currently 2 months behind on my car and thinking about BKing due to about $300k in debt. Can the finance company still repo my car?

Well, if you are listing your vehicle in the BK yes they will take it away, if not but are not paying the car then yes they will come repo it.

Your primary vehicle is usually exempt from a bankruptcy if it's the car you use to get to work. However there is a limit to the value of the car. You may have to trade down.

And until that bankruptcy is actually filed, they can repo the car; so you aren't protected until you actually file.

Or by BK did you mean Burger King? 'Cos if you did, then that's no protection at all. :)
