Can I sue a tow truck company?

My car was towed tonight. I parked in a visitor spot, and they claim I need a visitor pass to park in visitor parking. Nowhere does it mention the need for a visitor parking. There also is nowhere to pickup a visitor parking pass at the late hour that I drove to his place. This trip was spontaneous, and I asked my friend if I could park there, to which he assumed I could. I just want a refund, I don't want a handout. Do I have a legitiment case? I'm a poor college student that has to find $88 to get my car back.
 
talk to the manager of the complex first... make shoure if you need a parking ticket or not
 
u can ....but honestly $88 is really cheap for a tow especially after hours.......most places charge at least 150 ......but u should get it out quick ...cas it can b up to 50 per day u leave it in....

FIRST get ur car out....then ask for refund....and complain to manager of complex and or get the better business bureau involved...

then have all the tenants of the complex complain to owner of complex (not manager) to remove stupid permit needed rule.....

most likely the manager is getting a cut of the towing for drumming up business for the tow company.....cas someone had to call them...
 
I agree with the first response, tell the police its stolen as in fact it is.
Let the police debate the rights and wrongs of the action with the thief.

You should go back to this place and take photos of the entry and the parking spots.
If this was a block of apartments there will be some sort of body corporate, put it to the police that they are the ones puling the string of the two truck so should also be charged as he was acting under their directions to take your car.
 
there are some towing companies that are 'predators'....they wait for someone to park in a spot they can tow them out of just to make money.
I'd call the Better Business Bureau and make a complaint about the towing truck company.

Call and threaten them first and maybe they will let you have your car back without paying.

Remember, each day that goes by, your bill will go UP. They charge an 'inpounding' fee for each day that goes by.
