Can my ex contest my son picking up my maiden name?

His child support arrears have nothing to do with anything. Why would you air your dirty laundry like that?

Your son can use any name he wants as his "preferred" name, but legally, he cannot change his name without permission from both parents. Yes, your ex can contest this.

Wow another mom trying to wipe daddy out of his kids life because he owes her money.

My ex owes me too, but I never tried to step in between their relationship. What ever it may or may not be it was between the kids and him.

Teens never have good relationships with their parents. If he wants to change his name on his own with no influence from you than he should, but you do have to inform his father and his father can contest it. He is so close to 18 he should just wait until then.

Children are not tools for one parent to use against the other. They should be loved and cherished by BOTH parents.

My kids dad owes like 22K in back child support now and my son wants to pick up my maiden name because they have never gotten along. The courts say I have to notify his dad about this so my question is can my ex contest this? My son is only 16. My daughter has married so I don't have to worry about her.

he can contest it, but you can always tell your son to wait a year or two, whichever it is that your state's age of consent is, and he can legally change it to anything he wants.

Seriously - leave his name alone. I know that kids hear things - but the lack of child support payments is really none of his business. Tell your son that he is free to change his name when he is 18 and he can petition the civil court himself. He's had the name for 16 years, what's two more?

I believe that he can contest, however the Judge will make the final decision and worse comes to worse, he simply has 2 wait 2 years, until he's 18 and legally grown!
