Does a preowned Iphone still need a jailbreak?

My sister just recently gave me her old Iphone after she got the new Iphone4, but my service provider is T-mobile.I know how to switch the SIM cards, but I'm not sure if it still needs a jailbreak. Does it? And does it need to be unlocked as well?
