My friend had found and iphone laying outside in the snow on school property and then brought it to me and ask that i would sell it for him, so i had put it on craigslist and then two days later the school police officer called me down and questioned me, and now im being accused of stealing it. My friend found it and did not steal it, and he just told me to sell it so it was at my house. Now they said that i will be sent to juvenile court and they are going to see what my consequences will be. My friend that found it only got suspended from school for 2 days and he is not going to any court. They did not question him at all. So i am getting in trouble for what he did. The kid that lost his phone got his iphone back i returned it to the office upon request. I am 16 years old and i am just curious to what they will do in court to me. I have nothing on my record, and i have no past incidents. Please help. Im scared.

Why did your friend gave it to you on the first place? Why were you trying to sell the iPhone on Craigslist? You guys should have think first. You guys shouldve gave to the school office.
Right now, you can't to anything right now.

I'm going to let you and your friend in on a little secret: there is no iPhone fairy who drops iPhones around the world for deserving people. Any iPhone you see, for that matter just about any material thing that you see, is owned by someone. It might be lost, but someone owns it. If you find a lost item, you can either leave it there, or you can take it and turn it in to the police. If it isn't claimed by a certain time, then they'll give it to you. But you're not allowed to take stuff that's not yours. And neither is your friend. By taking something that didn't belong to him, your friend effectively stole the iPhone. If he'd left it there, there's a good chance that the owner would have returned to look for it. And by giving that iPhone to you to sell, he's proven that he knew that it was wrong to keep it, he was trying to shift the blame to you. He's not a good friend.

You will probably be charged with attempting to sell stolen goods and conspiracy to sell stolen goods. You'll probably be charged as a juvenile, not as an adult. You'll have a record, which will probably be sealed when you reach 18 if you don't do anything else.

Besides all this legal stuff, I want you to think for a few minutes. Do YOU have any valuable possessions? If you managed to lose a valuable possession, would you want the person who found it to turn it in, or try to sell it? You don't sound sorry that you did this, you only sound sorry that you were caught.

I doubt this is serious. BUT, on the off-hand chance it is. There is nothing to worry about. State clearly your situation, have your friend subpenead by your lawyer, and the truth will/may come out. Either way, you are guilty of recieving stolen items. Being 16, your case with automatically close and your file will be sealed (except to Homeland security), to everyone when you become 18. It will not haunt you unless you are looking for a very sensitive classified job, then, your testimony today will speak for you tomorrow..."just a stupid kid who had to learn the hard way."

So, let your lawyer get you a supended sentence, have your parents pay your fine, and move on.

Peace On Earth, Hell in Hell
