A young guy and his two friends were recklessly driving on the freeway when they lost control and crashed into my car head-on sending me spinning across the lanes and facing traffic. My sister was in the passenger seat. Both cars were considered totaled and all parties were taken via ambulance to the hospital with no major injuries (fractures, etc). A witness gave a statement accusing the other driver and the police report shows it was the other driver’s fault.
My sister injured her lower back and I injured various other parts of my body including a permanent knot in my shoulder and a permanently deviated clavicle along with cuts and bruises, busted lip, etc.. As I am no longer on speaking terms with my sister I do not know the extent of her injuries, the amount of her Dr. bills, or the total of her settlement (which I do know that she has received).
I have already been paid in full for the value of my car $10 G, my rental car bills $1 G, and my broken cell phone $300. I went to the Chiro for approx 6 ½ months, went to an Ortho Dr. once for a shoulder problem, and had an MRI done because of back pain. I also had several pain prescriptions. My medical bills in total including the ER/ambulance bills was approx $18.5 G+. I also missed three weeks of work directly after the accident.
I have a lawyer and as of right now we are going after his insurance. After she sent over the paperwork, the adjuster came back with $13 G as the settlement amount for bills/lost wages/pain & suffering. This seems ridiculous. If this is what I took, I would have to give my lawyer 33.3%, which would leave me with $8,600, thus making me responsible to come up with remaining 9-10 thousand dollars out of my own pocket to pay off the rest of the bills (and NO money left for lost wages or pain & suffering).
Unreal! Especially for something that wasn’t my fault in the first place!! (I also missed my uncle’s funeral as this is where we were headed when he ran into us).
My lawyer said we would keep working on the amount and see what they offer, but it has already been 3 months since she sent in the total amounts, and 2 months since they offered the 13 G.
I know there is no calculation for settlement amounts, but if anyone has accurate info (lawyers or insurance adjusters), I would like to know what you think about this case.
