I Just got a new phone from verizon and it doesnt work right...will they replace it?

I just upgraded my phone and I bought the LG cosmo touch, and it freezes until you take the battery out, and shuts off whenever it wants. Im going to take it back to verizon, will they replace me with a new one? I just got it less than a month ago
