i sold my truck to a friend who got it impounded, now they want me to pay?

first of all the truck wasn't to be driven until he got it running good enough to pass smog so he could register it. now the tow yard wants 2700 bucks and i lost the bill of sale. he's a loser and can't pay and probably wouldn't anyway i didn't see this coming can i sue in small claims court
 
The limitation for a lawsuit in small claims court is $5,000.00. So, yes you can sue him. In a civil case (which is what this would be) it is the greater weight of evidence that finds victory. So, basically, you have to bring as much evidence as possible to convince the judge that you are telling the truth and you deserve to get the money from your former friend. Since you said you have lost the bill of sale, this will not be easy. Was anyone present at time of sale? Will they accompany you and testify to it, or at the very least write and sign a notarized letter stating they witnessed the sale? Other than the missing bill of sale, is there any documentation at all proving your case? Did you sign the title over to your friend at time of sale? Can you ask the judge to have your friend show it in court? So, if you have more evidence than your friend, and can convince the judge with it, you could win. But be warned, if you miscalculate, you could be counter sued by your friend. Good luck.
