I was forced to stop on the rail road tracks is it considered a non moving violation?

It was early morning on my way to work there was a lot of taffic i was about to go over the tracks when this idiot in an suv jumps into me lane forcing me to stop on the tracks unable to move off the the tracks on either side due to traffic having boxed me in i had no other thing to do but wait and hope no train would after be stuck there for about ten minutes traffic began to move and low and behold a police officer was pulled over on the shoulder some ways down waiting for me to come through to pull me over as i explained what happend i got a ticket for being stopped on rail road tracks i mean i know that it is wrong to stop on the tracks but i would have made it if that car would have not jumped in front of me

tuff break.. sounds like the SUV should have got the ticket but the cop probably only saw your infraction. At least a train wasn't scheduled

It's considered a moving violation because it happened while you were driving.

And you should fight the ticket. If the officer was sitting there the whole time waiting for you, he should also have seen the SUV cut you off - and ticketed the SUV instead as being the vehicle responsible for creating the situation.

The officer is supposed to give you a ticket regardless. Now you can talk to your prosecutor and explain the situation, and if she agrees with you i think all she can do is give you the minimum fine. If your not happy with that talk plead not guilty when the judge calls you to the stand and explain to him. I would talk to a lawyer first. you dont have to pay a lawyer you can call some 80% of them give you free advice
