The kid can get it back in 5 days, but what happens if a person breaks in a steal it, would the the school be charged?

Whoever broke it would be responsible and if they couldn't figure out who broke it, it'd land on the school. They're taking it and need to keep it safe.
In middle school a kid had an MP3 player in math and the teacher took it and put it in his desk, a few days later someone broke into the teachers desk and took it. Then the school had to replace it.

well in our school we can use cell phones, our principal thinks that we are young adults and that we should be treated that way.

It depends... I know that my school has a disclaimer saying that they are not responsible for any damage to cell phone. So if your school is like mine the school wouldn't be in trouble.. if not they could be held responsible.
