I'm a bartender. We tip out 3% of our sales to the BAR. Is this legal?

Its like me paying them to work there.? We the staff at this bar tip out the bar 3% to the BAR. Yes BAR. Bartenders and Servers tip out the bar. We don't sell any food at all.
The owner just started to do this. Supposedly we tip out the bar for "credit card machines and glassware"
