iPod touch 4G Battery Bug (iOS 4.1)?

So I let my iPod die all the way and charge it when it's dead, but When it turns on when I connect to Power it says I have "40%" of battery left even though I Just plugged it in from it being Completely dead. Some people said I have a defective battery and need to get it replaced, If I don't get it replaced, with this harm my battery and iPod and make my battery weak in power?
 
Have you charged it to 100% then left it plugged in for a fewhours, then let it drain the battery, then charge to 100% again. I had to do this with my iPhone 3GS.
