Is it illegal to give someone HIV without knowing you have it yourself?

I am getting checked for STD's soon as I had unprotected sex many times with my ex boyfriend. But I remember when we first had sex I got quite ill (he also was ill) with a sore throat, cold, muscle ache and I read that it is a sign of HIV. Although this was in winter and it probably is just a coincidence but I wanted to know if I did have HIV would he get into trouble for giving it to me even if he didn't know he was infect? I haven't slept with anyone else.
 
It isn't illegal to give someone an STD normally
