Is the Cell Phone mine?

I was given a Iphone for my 18th birthday around December 17th that was on the gift givers plan on verizon. Now i want to switch the phone over to another plan. The owner of the plan is demanding i pay 160$ to switch it over but im certain that the phone is my property. I never agreed in writing to pay for my part of the bill but the plan owner assumed i would pay. I never payed anything.Since this phone is a gift, regardless of the plan it is on, is it my phone and can i do what i want with it?
 
Well technically you don't have to pay but since it is on the other persons account they can report it lost or stolen and you wont be able to activate it at all. The $160 is what they will have to pay verizon if you take the line off their plan.
