Hi, my husband and I purchased our home just over 2 years ago. Council has advised current the fence is not on the correct boundary line and our neighbour actually has some of "our" land. We have been issued with a council order to remove the existing fence and to pay half for the erection of a new retaining wall and new fence on correct boundary. Apparently council has been aware of this boundary issue for 10+ years and it has been fought out with previous owners. Our neighbour is making an issue about this because the retaining wall which sits where the boundary actually is (well within her backyard now) has failed and she wants us to pay half for it.
We believe we have the right to sue for encroachment as well as due compensation for the loss of our land and for the fraudulent sale of our property. Council has known about this for years, long before we purchased our home, surely we have a leg to stand on?
