The drunk driver was killed also. My brother and I are his only children. He was not married.

What do I need to due to collect or sue the insurance companies?

Do I sue the drunk driver's insurance company for wrongful death?

How should I procede?
I am in North Carolina.

What is the highest amount that an adult can recover from a wrongful death lawsuit of his father?
I have not talked to a lawyer yet
 
First, you must not sign any releases from either insurance company. Sometimes they will come to you with a check for $50,000 and ask you to sign a release. If you sign the release you can not sue them.

Second, your father's insurance company should not be sued. What did they do wrong? What did your father do wrong? They are both innocent of any fault. How can you morally justify suing innocent people who were not at fault? (I am talking morals. A lawyer will tell you different.)

Third, you do not sue the drunk driver's insurance company. You sue the drunk driver, his estate and his insurance company. If he came out of a bar, you sue the bar that sold him the last drink. You may not get anything from the bar but they need to pay more attention to the condition of their customers. (Some states have Dram Shop Laws that make bars criminally liable if they serve to obviously drunk person.)

Now, as far as money. If you and your brother are both over 18 you will not get much. You are adults, not dependent minors. You do not need your dad for support. If you are living on your own, that cuts how much you could get also as your dad was not housing you.
If you are minors you can get quite a bit. Enough to get by until you are 18 plus college money. But in this case you need a guardian to file the suit for you.

Sorry about your loss but your age is a big factor on what you could get.

Wow, umm.. I am still just a kid... (in 9th grade, 14 yrs old) so I don't really know what to say, man! Tough luck, dude, but I suggest you going to the embacy to clear things up with them because most of us here on Y!A are most likeely as clueless as you on this so like take it to the agency or whatever. Unless we're like Einstien, I doubt lots of us know it undoubtedly. Oh and by the way, we're ALL UNLIKE him soo... umm.. SORRY ABOUT YOU'RE DADD!!!!!!!!!!! But if you manage surviving this tragic and making it through, ur ultra brave I can never imagine myself but you're probably stronger considering you're a guy and that's not a rumor, that guys are in a sense stronger while girls on the other hand, then again are ultra SENSITIVE. And um.. GOOD LUCK ;D (Oh I think you're a guy, oh well lol)
 
first get a copy of the accident report from the police, you need a lawyer who will then be able to pursue the case in the proper manner, in the meantime don't discuss the accident with no one and don't sign any documents relating to the accident
 
You need to contact a lawyer in your area to get started on suing the insurance company. The insurance company is the only group you will be able to sue unless the person had an estate, in which you may be able to sue them.

The highest amount you'd be able to recover is either what he had for his liability on his insurance or what you can settle with the insurance company.
