...changed her mind what can I Do? I have it in an email that my x agreed to me taking my kids on vacation. Now that I have bought the plane tickets she said I can't take them. I was thinking of taking her to small claims court but I don't know if I have to wait tell I go on the vacation or if i can take her before the vacation?
 
This is a difficult one, as it depends on what type of custody arrangement was made. If there is a Court approved custody agreement and it authorizes you to take your kids on vacation during the time that you are doing so, you would be protected and your ex could not legally keep you from taking your kids on vacation. However, if there is no formal custody arrangement then you may have difficulty.

Talk with her to determine the real reason why she does not want you to take the kids. Maybe you can work something out.
 
I think you can sue her for the cost of the tickets. They were purchased in good faith and she damaged you monetarily by reneging on her word. This is really sad to deprive the kids, especially since the money has been spent. I hope you guys can work this out. It's not the kids fault you guys can't act like adults.
 
Take her back to family court if she is violating the terms of your custody agreement.
In most states if she chronically violates the custody agreement, she can lose custody permanently.
 
Guilt-trip her by laying it on thick how upset the children are that SHE is preventing the vacation
 
What exactly are you taking her to small claims court for?? is it because you are now changing your plans to go on vacation and want reimbursement? that's why I am confused, but you also ask if you should take her before or after vacation. Talk to your atty. You don't want anything to mess up visitation and custody. And keep that e-mail where she gave you permission!
